The Ministry of Justice of the Slovak Republic explains whether it is necessary to resubmit the agreement on the fulfillment of the authorized person’s obligations in the event of changes to the RPVS. The statement clarifies when the original agreement is sufficient and when there is an obligation to submit new documentation.

Is the beneficiary required to submit to the registry court any and all amendments to the Agreement on the Performance of the Beneficiary’s Obligations entered into between the beneficiary and the public sector partner?

Pursuant to Section 5(3) of the RPVS Act: “If the application for registration concerns the ultimate beneficial owner, a verification document shall be attached to the application. If the application for registration concerns an authorized person, the application for registration shall be accompanied by a declaration by the authorized person that they have no relationship with a public sector partner pursuant to Section 19, and a written agreement on the fulfillment of the authorized person’s obligations to the public sector partner.”

OPINION OF THE MINISTRY OF JUSTICE OF THE SLOVAK REPUBLIC:

The Register of Public Sector Partners is not configured to allow the submission (or re-upload) of an agreement on the performance of activities by an authorized person for a public sector partner unless the partner’s authorized person changes. If the agreement was valid at the time of its conclusion and served as the basis for the public sector partner’s entry in the register, there is, in our opinion, no legal reason or obligation to submit any amendments or addenda to this agreement to the registering authority in any form.
