COVID-19 and Its Impact on the Public Sector Partner Registry

The emergency situation caused by the COVID-19 pandemic and the subsequent state aid measures to support the economy have also affected Act No. 315/2016 Coll. on the Register of Public Sector Partners and on amendments to certain acts (hereinafter referred to as the “RPVS Act”).

COVID-19 and Its Impact on the Public Sector Partner Registry

Act No. 66/2020 Coll. amends, effective April 4, 2020, Act No. 5/2004 Coll. on Employment Services (hereinafter “Act No. 5/2004 Coll.”), which also stipulates that when implementing projects to support the maintenance of employment pursuant to Section 54(1)(e) e), an exception is established to the obligation to register in the Register of Public Sector Partners under the RPVS Act, specifically to simplify and expedite the provision of assistance to employers and self-employed persons who have been affected by the current pandemic crisis.

The above is directly enshrined in the provision of Section 72am of Act No. 5/2004 Coll. on Employment Services:

For an employer who is provided with a subsidy under projects pursuant to Section 54(1)(e) and who must be registered in the register of public sector partners, the obligation to register in the register of public sector partners is deemed fulfilled until December 31, December 2020, the obligation to register in the register of public sector partners shall be deemed fulfilled.”

These are various projects aimed at supporting job retention, including jobs where self-employment is carried out or operated, support the retention of employees in employment in connection with the situation caused by the COVID-19 pandemic and its consequences.

In connection with the above, we would like to point out that this does not affect the obligations to register with the RPVS arising from other legal regulations, such as the Act on the RPVS, Act No. 343/2015 Coll. on Public Procurement and on Amendments to Certain Acts, etc., i.e., if, for example, a commercial company meets the conditions for registration in the RPVS pursuant to Section 2 of the RPVS Act, it must be registered as a public sector partner in the Register of Public Sector Partners.
